General Terms and Conditions
1 - Acceptance of conditions
The customer acknowledges having read, at the time of placing the order, these general terms and conditions of sale and declares accepting them without reservation.
These terms and conditions govern the contractual relationship between ADRIEN MONTEIL, operating under the trade name Figuresdesign, and its customer. They shall prevail over any other conditions appearing in any other document, unless expressly agreed otherwise in writing.
2 - Products
The items offered for sale are often vintage or antique pieces and may show signs of age, wear, minor imperfections, restorations, or variations inherent to their production. These characteristics are considered normal and do not constitute defects.
ADRIEN MONTEIL, operating under the trade name Figuresdesign, endeavors to describe and present each item with the utmost accuracy. However, photographs and descriptions are provided for indicative purposes only and are not contractually binding.
Colors, textures, finishes, and visual aspects may vary depending on screen settings, lighting conditions, and individual perception. Such variations shall not be considered grounds for dispute or return.
The buyer acknowledges having carefully reviewed all photographs and descriptions prior to purchase.
3 - Ordering
Automatic recording systems are considered as proof of the nature, content, and date of the order.
The sale is deemed concluded upon receipt of full payment. Figuresdesign will confirm acceptance of the order by email.
In the event of unavailability of a product, Figuresdesign undertakes to reimburse the customer promptly.
Figuresdesign reserves the right to cancel any order from a customer with whom there is an ongoing dispute.
The information provided by the customer at the time of ordering is binding. ADRIEN MONTEIL shall not be held responsible for delivery issues resulting from incorrect or incomplete information.
4 - Delivery
Upon receipt of payment, delivery is estimated between one and six weeks. This timeframe may be extended in case of exceptional circumstances or stock constraints.
Deliveries within France are made via Mondial Relay, La Poste (Colissimo), or any carrier selected by Figuresdesign. Deliveries within the European Economic Area are made via similar services. For international shipments, appropriate international carriers are used.
For deliveries outside mainland France, the customer is responsible for all transport costs, customs duties, VAT, and any other applicable taxes.
For deliveries outside the European Union, the customer is considered the importer of record and is solely responsible for complying with all import regulations in the destination country. This includes the payment of all applicable taxes and the provision of any required information or documentation requested by customs authorities or carriers (such as identification numbers or tax IDs).
Failure or refusal to provide such information may result in shipment delays, return to sender, abandonment, or destruction of the goods. In such cases, ADRIEN MONTEIL, operating under the trade name Figuresdesign, shall not be held responsible for non-delivery.
All additional costs arising from such situations, including storage fees, return shipping costs, customs charges, or administrative fees, shall be borne entirely by the customer.
If a shipment is returned due to the customer's failure to comply with import requirements or refusal to accept delivery, Figuresdesign reserves the right to issue a refund reduced by all incurred costs, or to refuse a refund in cases of significant loss.
If the shipment is abandoned or destroyed due to the customer's inaction or refusal, no refund shall be due.
The customer is required to inspect the parcel upon receipt and notify the carrier within 48 hours of any damage or missing items.
5 - Prices and payment
Prices are indicated in euros. Payment is due in full at the time of ordering.
Prices include product cost and packaging. Shipping costs are charged separately.
Payment methods include PayPal, credit card (via Stripe), or other methods offered on the website.
Adrien Monteil, operating under the trade name Figuresdesign, reserves ownership of the goods until full payment has been received.
6 - Right of withdrawal and returns
For customers located within the European Union, a 14-day withdrawal period applies in accordance with applicable law. The customer may return the product without justification within this period. Return shipping costs are borne by the customer.
For customers located outside the European Union, returns are not automatically accepted and remain at the sole discretion of Figuresdesign.
For customers located in the United States, all sales are final and no returns or refunds will be accepted, except in the event of proven damage during transport or a significant error in the item description.
In all cases where a return is accepted, items must be returned in strictly identical condition to that in which they were received, in their original packaging. Any item that has been damaged, altered, or used will not be eligible for a refund.
Figuresdesign reserves the right to refuse any return that does not meet these conditions.
Refunds, when applicable, will be processed within a maximum of 15 days after receipt and inspection of the returned item.
7 - Liability
ADRIEN MONTEIL, operating under the trade name Figuresdesign, shall not be held liable for indirect damages or losses.
Figuresdesign shall not be held responsible for delays, non-delivery, or additional costs resulting from customs clearance procedures or the customer's failure to comply with import requirements.
Figuresdesign shall not be held liable for damages, delays, or losses attributable to the carrier once the shipment has been handed over, except where otherwise required by applicable law.
Figuresdesign shall not be held liable for any failure or delay in performance due to events beyond its control, including but not limited to strikes, transport disruptions, customs delays, or force majeure events.
In any case, liability shall be limited to the amount of the order.
8 - Personal use
Orders are intended for personal use only. The customer agrees to ensure that any recipient of the order accepts these terms and conditions.
9 - Legal information
Figuresdesign is the trade name of Adrien Monteil, registered as a sole trader in France.
Personal information collected is necessary for order processing and delivery.
In accordance with applicable data protection laws, the customer has the right to access, rectify, and delete personal data by contacting Figuresdesign.
Adrien Monteil, operating under the trade name Figuresdesign, undertakes not to share customer data with third parties.
